Widow Sues Malcolm-Jamal Warner’s Mother
The widow of Malcolm-Jamal Warner has filed a lawsuit against the late actor’s mother, alleging that he failed to fulfill the financial obligations outlined in their prenuptial agreement before his death.
Tenisha Warner filed the complaint on July 20 in DeKalb County Superior Court in Georgia, exactly one year after the actor drowned during a family vacation in Costa Rica. The lawsuit names Pamela Warner, Malcolm-Jamal Warner’s mother, in her role as successor trustee of the Warner Family Trust, which was established in 1996.
According to the complaint, Tenisha and Malcolm-Jamal Warner married on May 23, 2022, after signing a prenuptial agreement on May 15 of that year. The lawsuit alleges that the actor agreed to maintain a $1 million term life insurance policy naming her as the sole beneficiary but failed to obtain or maintain the coverage.
Lawsuit Seeks More Than $1.2 Million
The complaint claims Tenisha Warner is owed at least $1,276,042.46 under the terms of the agreement.
In addition to the alleged unpaid life insurance policy, the lawsuit states that Warner failed to:
- Make annual tax-free payments of $16,000.
- Contribute to a Roth IRA on her behalf.
- Pay her a monthly salary of $5,000 for serving as his chief of staff.
Tenisha Warner argues that the actor’s estate lacks sufficient assets to satisfy the alleged obligations. She is asking the court to allow recovery from the Warner Family Trust instead.
The lawsuit also seeks interest on the claimed amount, attorney’s fees, and an injunction preventing trust assets from being distributed while the legal dispute is ongoing.
Trust Dispute Centers on Family Estate
According to the filing, the Warner Family Trust predates both the couple’s marriage and the birth of their 9-year-old daughter.
Tenisha Warner is asking the court to recognize both herself and the couple’s daughter as omitted spouse and omitted heir beneficiaries under the trust’s provisions.
As of publication, neither Pamela Warner nor representatives for the actor’s estate have publicly responded to the allegations contained in the lawsuit.
Malcolm-Jamal Warner Died in 2025
Malcolm-Jamal Warner, best known for portraying Theo Huxtable on The Cosby Show, died on July 20, 2025, at the age of 54.
Costa Rican authorities said the actor was swimming at Playa Grande de Cocles during a family vacation when he was caught in a rip current. He was pronounced dead at the scene despite resuscitation efforts by emergency responders.
On the first anniversary of his death, Pamela Warner shared a tribute to her son on his memorial Instagram account.
The claims made in the lawsuit have not been tested in court, and no rulings have been made regarding the alleged breaches of the prenuptial agreement.
