Lindsay Clancy returned to Tewksbury State Hospital in Massachusetts after her murder trial ended in a mistrial Friday, Sept. 4, leaving her in state custody as prosecutors decide whether to seek a retrial.
The 36-year-old former labor and delivery nurse had been held at the psychiatric facility for more than three years following the January 2023 deaths of her three children.
She remains there without bail after jurors failed to reach a unanimous verdict on whether she was criminally responsible for the killings.
The jury deliberated for seven days before notifying Judge William Sullivan that it remained deadlocked.
The judge declared a mistrial after the Massachusetts Supreme Judicial Court rejected an emergency bid by Clancy’s defense team to halt the proceedings.
Why Is Lindsay Clancy at Tewksbury Hospital?
Clancy’s stay at Tewksbury began after she survived a suicide attempt following the deaths of her children, Cora, 5, Dawson, 3, and Callan, 8 months, on Jan. 24, 2023.
She was initially treated at hospitals for injuries sustained after cutting herself and jumping from a second-story window.
She was later transferred through medical and rehabilitation care before being moved to Tewksbury State Hospital, where she has remained in state custody.
Tewksbury is a state psychiatric hospital and not a conventional prison.
Clancy has continued to receive medical and psychiatric care there while facing the murder charges.
She has been paralyzed from the waist down since the 2023 fall and has appeared in court in a wheelchair, affecting how she is housed and transported.
What Has Her Life at Tewksbury Been Like?
Details about Clancy’s life at the hospital emerged during testimony in her trial.
Dr. Avram Mack, a psychiatrist who evaluated Clancy at Tewksbury for the prosecution, testified that she had interacted with hospital staff, received physical therapy and had visits from family members and religious figures.
Mack also testified that Clancy told him she was not particularly interested in physical therapy or the hospital’s food and had little interest in her own hygiene and grooming.
What Happens to Lindsay Clancy After the Mistrial?
The mistrial does not mean Clancy has been acquitted or charges disappeared.
Prosecutors could seek a new trial, pursue a plea agreement or decide not to retry the case. A court hearing is scheduled for Sept. 29.
Her defense could also seek changes to her custody or bail conditions, though a mistrial does not automatically entitle a defendant charged with first-degree murder to release.
If prosecutors retry the case and Clancy is convicted of first-degree murder, Massachusetts law provides for life imprisonment without parole.
If found not guilty by reason of insanity in a future proceeding, she could remain committed to a state psychiatric facility subject to periodic review.
