Exclusive | Halle Berry restraining order extended as court battle drags into second week

Olivier Martinez’s temporary restraining order against Halle Berry has been extended through the weekend, with the divorced couple’s explosive custody battle boiling over into next week.

The “Monster’s Ball” star and French actor returned to Stanley Mosk Courthouse in Los Angeles for the fifth day of hearings Friday to address allegations that Berry abused their 13-year-old son, Maceo.

In court, Martinez, 60, continued his closed-door testimony from Thursday, in which he doubled down on his claims that Berry abused him, despite being confronted with his 2024 sworn statement which said the former couple had no history of domestic violence.

After a lunch break, Berry’s fiancé, Van Hunt, 56, took the stand. His testimony was also held behind closed doors.

Hunt appeared relieved to be finished as he left the courtroom alone around 4 p.m., but he was later seen laughing with a member of Berry’s legal team.

After court adjourned at 4:30 p.m., Martinez and his attorneys exited the courtroom together, followed by Berry and her team.

Berry, 60, was seen rubbing Hunt’s arm in the hallway before leaving the courthouse with her team.
Berry’s daughter, Nahla Aubry, 18, is expected to testify virtually Monday when the hearing resumes.

On Thursday, Berry’s attorney, Marina Beck, questioned Martinez during cross-examination on day four of proceedings in their domestic violence restraining order hearing and custody dispute, asking him about allegations she’d abused him during their relationship — including alleged incidents from a decade ago.

The attorney presented the French actor with a declaration he signed two years ago under penalty of perjury, which stated they’d had no history of domestic violence.

Martinez confirmed the signature to be his and Beck asked, “That statement was true when you made it on September 30th, 2024, correct?” He replied, “correct.”

Patrick Baghdaserians, Martinez’s lawyer, told Page Six that the 2024 declaration was in regards to a financial request.

“There was no conviction of domestic violence at the time so his statement is correct,” he told us. “At the time there was no restraining order ever requested, ever entered.”

He continued, “So the statement, it’s correct. There is no history of domestic violence restraining orders. But again, that is not for anything related to custody, it’s for need-based attorneys fees.”

Earlier in the day on Thursday, Berry testified in a closed courtroom about Maceo — who himself spent upwards of four hours on the witness stand during closed-door proceedings earlier this week.

The court appearances stem from Martinez’s allegation that the Oscar winner choked their teen son during an alleged confrontation at her home on Sept. 26.

Martinez has argued that the incident is endemic of a ongoing abusive behavior, and claimed that Maceo reached out to him following the incident asking to be picked up.

A judge previously granted Martinez a temporary domestic violence restraining order — and his request for primary custody of Maceo. The arrangement limits Berry’s time with Maceo during the case.

Beck previously told Page Six that Martinez’s claims were “entirely meritless and deliberately misleading,” and stressed that her client vigorously denies allegations of wrongdoing.

Berry’s daughter Nahla Aubry, 18, previously submitted a court declaration stating she’d never seen the actress abuse Maceo.

Berry’s attorneys have alleged in documents that Martinez has meddled with Maceo’s education and therapy, and accused him of involving Maceo in their ongoing dispute.

Berry has asked for sole legal custody — enabling her to better oversee Maceos’ education, therapy and medical care — and for the restraining order to be dismissed.

She’s asked the court to restore the previously instated 50/50 physical custody agreement, as well.

Martinez and Berry tied the knot in a private ceremony in 2013, welcoming their only child later that same year. They separated in 2015.

The former couple seemingly settled their divorce in 2023 after years of legal wrangling, with Berry being ordered to pay her ex-husband $8,000 per month in child support.
