(NewsNation) — Delta Air Lines offered passengers on board an ill-fated flight to Toronto $30,000. Two travelers are suing instead.
A Minnesota woman and Texas man have filed against the airline just days after the CRJ-900 aircraft they were on crashed and flipped upon landing in Canada.
One suit describes “severe emotional distress and mental anguish” endured. The Texan claims Monday’s incident on Flight 4819 left him with “significant injuries to his head, neck, back, knees and face.”
Another passenger’s suit details a similar ordeal, citing the flight crew’s failures for her “extreme bodily and mental injuries,” local media outlets first reported.
All 21 people injured in the crash landing have been released from the hospital, and no one was killed.
If all 76 travelers on Tuesday’s trip were to take the $30,000 offered by Delta, the company would owe $2.3 million to those customers. It’s unclear what compensation, if any, the crew members are being offered.
NewsNation local affiliate WWLP asked whether passengers who accept the offer would be required to sign away their rights to seek further compensation or sue the airline.
A spokesperson for Delta indicated that was not the case: “Delta Care Team representatives are telling customers this gesture has no strings attached and does not affect rights.”
