Lawyer for Kim Zolciak’s Son KJ Explains Why Full Details of Sexual Assault Case “Cannot” Be Heard Yet

“An arrest and an indictment cannot tell us the whole truth of a case because, at those stages, the magistrate judge and the grand jury have heard only one side,” he said. “The accused has no right to participate, present evidence, cross-examine witnesses, or have a voice in the proceeding.”

As such, Sheffield explained KJ’s side hasn’t yet been shared, clarifying that the assessment was not “a criticism” of the process, but rather “simply where we are.”

KJ is currently detained following his Aug. 17 arrest in Alpharetta, Ga., and his lawyer looks forward to presenting evidence he says will clear the charges against his client.

“Without DNA evidence, the case remains one of ‘she said, he said.'” Sheffield wrote. “The evidence that I have gathered will prove, at the appropriate time and place, that KJ Biermann is not guilty of these horrific allegations.”
